Terms and Conditions

This registration site for Photoscape 3D is managed by McCarthyTaylor Systems Ltd., the creators of the Photoscape 3D software in conjunction with their partners Getmapping PLC, Intermap Technologies Inc and Bluesky International Ltd.

These terms and conditions relate to your purchase of a licence to use an additional geographic region with your Photoscape 3D software and govern the sale contract between us. Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these Terms and Conditions. The use of the software and regional data is governed by an End User Licence Agreement (‘EULA’), which may also be viewed on this site.

The ‘we’ and ‘us’ referred to below is McCarthyTaylor Systems Ltd. and our contact details are at the end of this document.

These Terms and Conditions do not affect your statutory rights.

Sale offer

a) Your first geographical region is included in the purchase price of the Photoscape 3D software licence and its activation code is provided without further cost. We will charge you to activate additional regions or to activate the first region on a different computer.

b) When you complete and submit an electronic order for a licence from our website at http://register.photoscape3d.com you are making an offer to purchase that, if accepted by us, will result in a binding contract with us. Your contract with us will commence when we supply a valid registration code at the correct price. All payments will be handled by WorldPay Ltd and are subject to their terms and conditions.

c) On completion of a successful payment transaction we will display a registration code on screen and send a copy of this code to the e-mail address you have provided. You must type this code into your Photoscape 3D software in order to activate the region you have chosen.

d) All software and regional data is copyright Getmapping PLC and its suppliers Intermap Technologies Inc., Bluesky International Ltd., and McCarthy Taylor Systems Ltd. It is protected by copyright laws and international copyright treaties and may not be used in any way except in accordance with the End User Licence Agreement displayed on the www.photoscape3d.com web site. These products are licensed, not sold. Any licence purchased is personal to you and is granted for your benefit only.

e) Any advice or recommendations given by any representative of McCarthyTaylor Systems or its partners relating to resources, which is not confirmed by us in writing, will not be binding on us. Any variation to these terms and conditions will be acknowledged on the website.

f) Throughout the website and ordering process and in all correspondence we use the English Language. No other languages are available on this website.

Ordering

a) In submitting an order you, the buyer, acknowledge that all information and specifications relating to the products produced by us and our partners for Photoscape 3D are approximate and all errors on the website may be corrected without any liability to us. Images may vary from those supplied because of monitor and printer capabilities and last minute changes made by us.

b) We may make any changes to the specification of the products to conform to any statutory or European requirements.

Pricing

a) The price of any licence shall be the price as quoted on the website on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by us.

b) The price of the licence includes any applicable Value Added Tax, which you shall be liable to pay.

Credit cards

a) All payments by credit/debit cards will be handled by WorldPay Ltd and taken prior to release of registration codes. Any fraudulent use of Credit/Debit cards will be notified to the authorities along with any identification details that were supplied with the order. The credit and debit cards accepted for payment are listed on the WorldPay website.

b) Any refund made to your credit or debit card shall be subject to the Terms and Conditions of WorldPay Ltd and of the Issuing Bank and therefore be subject to any time delay as specified by the Issuing Bank. No liability shall be placed on us for any delay that is outside of our control. A correct cardholder name and address must be supplied with every order.

Delivery

a) If you do not receive the registration code as specified on the original order, you must notify us in writing within 14 working days from the date of order. If you do not do so, no liability will be attached to us. In any event any loss or damage suffered by you as a result of such a delivery shall be limited to the price of the licence not delivered or the cost of a replacement licence.

b) As licensee you own only the case containing the original Photoscape3D software. Please see the End User Licence Agreement. We shall at all times retain ownership of the software and all other elements of the product.

Right of cancellation

a) Under The Consumer Protection (Distance Selling) Regulations 2000 you agree that you do not have the right to cancel once the performance of the services has begun and the registration code for the software has been issued.

Warranty

a) Subject to the conditions set out below, we warrant that the licence will correspond with the order at the time of delivery and will be free from defects on delivery. If we are in breach of this warranty, you shall notify us within 14 working days from the date of discovery of the defect. On receiving a notice of failure of warranty, we may (at our sole option) either replace the registration code or refund the price of the licence for which the registration code is defective. This shall be the extent of our liability and no consequential loss claim of any kind shall be made against us.

Withdrawal of products

a) We may withdraw the sale or distribution of any products produced by or generally supplied by us without prior notice or liability.

Court jurisdiction

a) The Contract and these Terms and Conditions shall be under English law and
the parties submit to the exclusive jurisdiction of the English Courts if
there are any disputes between them of any kind.

b) These Terms and Conditions are in line with The Consumer Protection (Distance Selling) Regulations 2000 and the EU Distance Sales Directive of 1998 and the Privacy and Electronic Communications Regulations 2003.
